Glossary
What Are RFEs and NOIDs?
RFE (Request for Evidence): A notice from USCIS stating that your petition needs additional evidence or clarification before a decision can be made. While concerning, an RFE is NOT a denial, it’s an opportunity to strengthen your case.
NOID (Notice of Intent to Deny): A more serious notice indicating USCIS intends to deny your petition based on current evidence. You have one final chance to respond and address their concerns before a final decision.
Common Reasons for RFEs/NOIDs:
- Insufficient evidence for claimed criteria
- Weak documentation or lack of context
- Evidence doesn’t clearly demonstrate “extraordinary ability.”
- Missing required documentation
- Inconsistencies in the petition or forms
- USCIS officer doesn’t understand your field/achievements
- Changes in USCIS policy since filing
The Good News
With the right response strategy, many RFEs and even NOIDs can be overcome. We’ve helped several clients turn RFEs/NOIDs into approvals.
